Background

“The board of county commissioners ignored the overwhelming opposition of the public... [and] numerous fundamental flaws inherent within GlobalAI’s proposal,” according to a 26-page complaint filed by business owners on Tuesday.

Weld County had amended its building code in January to anticipate GlobalAI’s proposal after the company purchased property in Windsor, Colorado, in November 2025. This change allows the county to grant data centers "use by special review" in light industrial zones with noise limits and letters from local utilities guaranteeing power and water supply.

The Lawsuit

Business groups GWIP Land Company and Windsor Renewal sued Weld County and GlobalAI in state court on Tuesday, arguing:

  • The county wrongfully approved GlobalAI’s special review request despite the tech company’s inadequate noise mitigation plans for a facility producing noise equivalent to 200 homes.
  • GlobalAI secured only a temporary water supply, failing to address refilling its 65,000 gallon closed-loop system every three years.
  • The local utility, Poudre Valley REA, expressed doubt about providing consistent electricity for the data center requiring power equivalent to 200 homes.

The county’s director of oil and gas recommended asking GlobalAI to generate all its first phase power on site to cover these shortfalls.

Context

This lawsuit follows months of construction by GlobalAI despite notices from a local building inspector serving them with code violations.
